Haiti - DR : Vinicio Castillo contests the mass regularization decided by the MIP

Following the statements of Washington González, Deputy Minister of the Ministry of Interior and Police (MIP), stating that 82% of people (+/- 239,000) in an irregular migratory situation in the Dominican Republic, registered in the National Plan of Regularization of Foreigners (PNRE), will be regularized, with the delivery of non-residents card for 1 year (for those who are registered with a birth certificate, identity card) and 2 years for those registered with a passport, the Deputy Vinicio Castillo of the National Progressive Force (FNP) has reacted strongly.

He considers as "illegal and unconstitutional" the disposition of MIP, while less than 10% of registrants meet the requirements of the law and the decree 327-13.

"The government waited the period stipulated in Decree 327-13 to kick the country, declaring in practice a general amnesty [default] for 288,000 registered, to whom it regularizes their legal status in DR without complying with the requirements of Decree 327-13. He violates its own legality," recalling that Article 4 of Decree 327-13 of President Danilo Medina is very clear "The foreign in a irregular situation, that in the period set for this plan was not eligible or not prevailed of the established regularization provisions will be subject to deportation under the Constitution and laws.

Paragraph. All expulsion proceedings are conducted under the provisions of the Migration Act, its Implementing Regulations and this Plan will be subject to the migration process, according to international standards governing the matter."

Vinicio Castillo asserts that this provision "on General Amnesty" of the government for illegal Haitian registered in the PNRE, is illegal and will be challenged in court. For him, this decision serves more as a propaganda of the Dominican Government to sell the world the image of 288,000 illegal Haitian regularized, that rigorously enforce its own decree 327-13.

He is convinced that this situation happened because the governments of both countries wanted to sell this positive image, which gives legal status to all Haitians enrolled in PNRE.
