Haiti - Constitution : The Prime Minister will replace the President in its absence

Replacement of the President :

Article 149 of the constitution of 1987, has been voted. Now, this is the Prime Minister who will take the reins of the executive in case of absence or vacancy of president. It will have to organize the election for a new president within a period of 60 to 120 days. However, if the president to be replaced has reached the fourth year of its mandate, this is the Parliament that will appoint a new President for the remaining time of the mandate. Note that this Article 149 does not specify the origin of that person that the parliamentarians can put at the head of the country.

Army :

In the amended constitution, the parliamentarians have repealed an article of the declaration of amendment concerning the army. This amendment confirms the retention in the Constitution of the Armed Forces of Haiti (FAd'H) dissolved in 1995 after the return from exile of President Jean-Bertrand Aristide.

Constitutional Council :

The declaration of amendment adopted by 81 votes, 10 abstentions and 0 votes against has allowed to create a new institution named "Constitutional Council" whose role is to rule on the constitutionality of laws.

The interpellation of the Prime Minister :

The parliamentarians have rejected [66 votes against, 31 for and 2 abstentions] the article of the declaration of constitutional revision prohibiting to the latter, to interpellate the Prime Minister less than one year after a vote of confidence. Upon proposal of Senator Steven Benoit, the Assembly has shortened the period between two interpellations, which is now 6 months.
