Haiti - Justice : Two UN agencies concerned about the American deportation of migrants to Haiti

Tuesday, September 21, 2021, during a joint press briefing, two UN agencies : the Office of the United Nations High Commissioner for Human Rights (UNHCR) and the United Nations Refugee Agency (UNHCR) said they were concerned about the US deportation of migrants to Haiti. They feel that those sent home may not have received the necessary protection they need.

Marta Hurtado UNHCR spokesperson questioned on the action of the American authorities to expel some 15,000 mainly Haitian people who live in a makeshift camp under the international highway bridge that connects Del Río (South Texas) to Acuña (Mexico) replied "We are disturbed by the images that we have seen [...] It appears that there has not been any individual assessment on the case [...] Some migrants may have genuine fears of being deported back to their countries, such as Haiti, which is in a state of political turmoil" adding "regardless of a person's migration status, everyone has the same rights and has the right to the same protection [...]"

Recall that the United States expels migrants by invoking Title 42 a health law that entered into force in March 2020 after the "Centers for Disease Control and Prevention" declared that it was necessary to limit the spread of Covid-19 .

Shabia Mantoo, spokesperson for the United Nations Refugee Agency said some of the migrants living under the bridge "may have well-founded grounds to request international protection" adding "While some people arriving at the border may not be refugees, anyone who does have a claim or claims to have a well-founded fear of being persecuted in their country of origin should have access to asylum and to have their claim assessed before being subjected to expulsion or deportation."

Recall that US law states that if a migrant is arrested within 100 miles of a border in the United States, as part of the procedure "expedited removal" is entitled to meet with an officer of the asylum service which will determine whether or not the individual can return to his country or not.
