Haiti - Technology : The legal obstacles to the E-Governance

The National Press of Haiti in partnership with the Superior School of Infotronique of Haiti (ESIH) have presented last Thursday the "Secure electronic transmission program" developed by two students of 3rd year of the ESIH.

This program aims to reduce the time of publication of records of companies in the official newspaper "Le Moniteur" from 45 business days to 7 days.

The messages transmitted will be encrypted and secured in case they are intercepted stated Patrick Attié, Vice-Rector of the ESIH.

Mr. Edouard the Director General of the National Press of Haiti, has explained that initially, this program will allow to the law firms, notaries and the Ministry of Justice to transfer by email to the National Press of Haiti (PNDH) of records previously deposited to the Ministry of Commerce and Industry, before being, in a second time, made ​​available to all the other users concerned

According to Ms. Jocelyne Colimon Féthière, the Minister of Trade and Industry, this program contributes to the efforts of the Haitian State to provide a better answer to the needs of investors and to accelerate the creation of jobs.

However, Me Bernard Gousse who intervened at the presentation of the program has emphasized on the legal aspects of this project, noting that the haitian legislature did not recognize the electronic administration (e-government) "the haitian law, opposes an insurmountable obstacle to the transmission of electronic document and to the modernization of business [...] it is necessary to achieve a reform of the legal framework, in order that the electronic documents have the same quality than the paper documents."

Indeed, the electronic signature is not recognized today in Haiti, in the neighboring countries and on the international market it occupies a significant place, Haiti ranks last with an index of 0.01 to 1.

Emphasizing on the needs of a legislation on the signature and electronic commerce, Me Gousse stressed that "all these conditions must be met in order to give a legal force to the digital documents" which should also take into account the administrative procedures, of transmissions of electronic documents between public entities and distance procedures, key elements of a modern e-governance.
