Haiti - AGD : Failure to comply with the customs code can be very expensive

Julcène Edouard, Director General of the General Customs Administration (AGD) informs economic operators, importers of goods, managers of customs offices, all customs staff and the public in general that, following the instructions of the Minister of Economy and Finance when filing the detailed declaration of goods imported or to be exported at a customs office, that it is prohibited to upload unprinted documents such as only blank pages or scanned printed documents having no relation to the goods imported or to be exported.

In accordance with article 299 paragraph 10 of the Decree of March 21, 2023 on the Customs Code, for any upload to the automated customs system of unprinted documents or scanned printed documents having no relation to the goods imported or to be exported, aimed at evading or compromising duties and taxes, a fine of 10% of the customs value of goods imported or to be exported is applied on customs slips (Notice No BM/AGD/0009/ 10-2023 published on October 2, 2023)

In accordance with article 299 paragraph 2 of the Decree of March 21, 2023 establishing the Customs Code:

1- For any false declaration in the species, value, origin or quantities of goods imported, to be exported or placed under a suspensive regime, a fine of 50% of the customs value of the imported goods, to be exported or placed under a suspensive regime is applied to the customs slips.

2- Regarding false declaration of the species or origin of goods imported, to be exported or placed under a suspensive regime, if no customs duty or tax whatsoever is evaded in the compromise, no fine will be applied.

However, the customs services will correct the customs declaration before the liquidation of any duties and taxes (Notice No BM/AGD/0007/10-2023 published on October 2, 2023)

In accordance with article 299 paragraph 12, of the Decree of March 21, 2023 establishing the Customs Code, in the event of late submission of customs declarations, a fine of 10% of the customs value of the imported goods is applied on the customs slips, whether these goods are subject to or exempt from customs duties.
