Haiti - Economy : Minimum Wage, 300 Gourdes on 1 October 2012...

Following the note of the Ministry of Social Affairs and Labour, in early September, recalling the last date of the Law on the minimum wage [Aticle 2.2], Josépha Gauthier the Minister of Social Affairs announced Thursday during a meeting with representatives of the trade union sector and representatives of the business sector engaged in the subcontracting that the 3rd component of the Act establishing the minimum wage, published in the official gazette, Le Moniteur No. 109, October 6, 2009 will come into force on 1 October 2012. This meeting reflects the willingness of Ministry to play its regulatory role.

The minimum wage of reference of enterprises exclusively oriented towards the re export and employing essentially of staff paid to the task [piece, dozen, grosse, meter etc...] will have to allow the workers, of totaling an income of at least 300 gourdes per day.

According to Article 96 of the Labour Code, the normal hours of work is 8 hours per day and 48 hours a week. Without exceeding 9 hours per day for industrial plants and 10 hours per day for commercial establishments and offices. Beyond the number of hours prescribed by law, overtime shall be increased by 50%.

Law fixing the minimum wage to pay in the industrial and commercial establishments (Le Moniteur No. 109 / Tuesday, October 6, 2009)

"[...] Article 1.- From 1 October 2009, the minimum wage to pay in the industrial and commercial establishments is set to Two Hundred (200) Gourdes per day of eight (8) hours.

Article 2.- From 1 October 2009, for industrial plants exclusively oriented towards the re export and employing essentially their staff in piecework or task, the price paid for the unit (including the piece, dozen, grosse, meter) must be set to allow the worker to realize for its day of eight (8) hours at least Two Hundred (200) gourdes set in Article 1 of this Act, the minimum wage of reference in these establishments being set at One Hundred Twenty-Five (125) gourdes.

Article 2.1. From 1 October 2010, for industrial plants exclusively oriented towards the re export and employing essentially their staff in piecework or task, the price paid for the unit (including the piece, dozen, grosse, meter) must be set to allow the worker to realize for its day of eight (8) hours at least Two Hundred Fifty (250) Gourdes; the minimum wage of reference in these establishments being set to One Hundred Fifty (150) Gourdes.

Article 2.2. From 1 October 2012, for industrial plants exclusively oriented towards the re export and employing essentially their staff in piecework or task, the price paid for the unit (including the piece, dozen, grosse, meter) must be set to allow the worker to realize for its day of eight (8) hours at least Three Hundred (300) Gourdes; the minimum wage of reference in these establishments being set to Two Hundred (200) Gourdes."
