Haiti - FLASH : Daméus backs on his request for blocking bank accounts

24 hours after the decision of the Government Commissioner Clamé-Ocman Daméus (Monday, November 12) to ask the Banks as a precautionary measure, beyond the legal requirements and the criminal procedure and his powers, to suspend the accounts of 36 commercial companies https://www.haitilibre.com/en/news-26099-haiti-flash-dameus-asks-banks-to-block-the-accounts-of-36-companies.html and after the strong and quick reactions of some of the indexed companies, he has decided to postpone this measure and asks the banks to unblock the accounts of these 36 companies (accounts that have never been blocked, the blocking request the Commissioner has no legal effect).

Note dated November 13 from Me Daméus :

"The Public Prosecutor's Office at the Port-au-Prince Court of First Instance informs the public, in general, the directors of Haitian banking institutions and those concerned, in particular that, following meetings held with certain managers of companies targeted by the provisional measures taken by the Public Prosecutor's Office on November 12, 2018, thus putting to the test their good faith, and the guarantee of their representation, the Government Commissioner Clamé-Ocman Daméus, decides to cancel the said measures to allow their CEO to compile their files for filing with the Public Prosecutor's Office for a thorough analysis of their situation.

In this interval, he formally authorizes the said banks to unlock bank accounts and resume financial transactions with these companies and their shareholders.

The Port-au-Prince Public Prosecutor's Office relies on the cooperation of these banking institutions for the immediate implementation of this measure; and on the diligence of the other concerned who could not meet the Commissioner to bring the necessary documents allowing him to continue the analysis in progress
